The Supreme Court stayed the order of Mumbai College to ban hijab, burqa, cap, or niqab. The Supreme Court stated on Friday that female students have the freedom to wear whatever they like.
The division bench of Justices Sanjiv Khanna and Sanjay Kumar declared that female students cannot be forced to wear anything by the college administration.
The judges told the college administration, “All of a sudden, you were able to comprehend that there are people in India who practice a variety of religions!” Surprisingly, though, female students were not told by college administration not to wear bindis or tilaks!
If clothing can reveal someone’s religion, judges want to know. However, their names also reveal their religious affiliation, right?
This instruction was given to the female students at Chembur, Mumbai, by the Trombay Education Society. The Bombay High Court upheld the order after a case was filed to challenge it.
The order of the High Court was challenged by the Supreme Court.The petitioners said that due to this ban, Muslim students are not able to attend classes. The Supreme Court suspended the order and said that the college authorities should give their opinion by November 18.
However, the Supreme Court said that no student can enter the classroom wearing a burqa. college Religious activities cannot be done on the premises. The judges said that if their instructions are misused, the college authorities can approach the court.
